Notice and filing requirements are critical in your ability to protect your rights under a Mechanics Lien. If you are a subcontractor who worked on an owner occupied single family home, there are a number of notice requirements that you must comply with in order to be successful in enforcing a Mechanics Lien. For example, for a mechanic's lien to be effective, you must give a notice to the homeowner within 60 days of the beginning of work. After completion of the project, you must give a notice within 90 days of informing the owner of your services and that you are claiming a lien. The lien itself must be filed within four months of finishing work. Because Mechanics Liens are statutory in nature, strict compliance with the law is required, and a failure to comply with the notice, and any other requirements may make your Mechanics Lien unenforceable.
