What's Involved in a Driver's License Reinstatement?

In order to reinstate your driver's license, the following process is typically involved:

  1. You must first send in a written request for a driver's license reinstatement hearing to the Secretary of State.
  2. After the Secretary of State receives your request, a hearing date will be issued to you no later than 90 days after your initial request is received.
  3. A hearing officer will be assigned to your case who will listen to your testimony, consider any evidence submitted by you, and evaluate the reasons for your license suspension or revocation. After taking these factors into consideration, he or she will submit a report regarding your case.
  4. You will be notified one to three months later of whether or not your request to reinstate your license has been approved or denied.

What Can I expect at the Hearing?

At a license reinstatement hearing, your driving record will reviewed and you'll be asked anywhere between 80 and 100 questions. You may be asked why your license was suspended in the first place, if you've taken steps to address a drug or alcohol problem, whether you can afford car insurance, if you're employed, or whether you understand certain points regarding the law. If you appear unprepared or are unable to answer questions satisfactorily, your hearing officer may conclude you aren't serious about driving responsibly.

Why do I Need an Attorney?

Having an attorney present not only indicates the level of seriousness with which you take your reinstatement hearing, it also provides you with much needed legal counsel should legal questions arise. If you hire one of our attorneys to represent you, we help prepare you for the questions you'll be asked, discuss how you can position your case more effectively, and discuss steps you can take to bolster your case. Our office can refer you to driver's education classes and help you find drug or alcohol counseling programs if a DUI or drug charge was involved in the suspension of your license.
